In Virginia, the speeding laws are divided into two main categories:

  2. Basic speeding Laws
  1. The Absolute Speeding Law:
    According to the absolute speeding law if the driver is speeding above the specified speed limit he/she will be subjected to the speeding ticket. Majority of regions in the United States have an absolute speed limit in major highway areas.

In Virginia, the absolute speed limit differs with the area and vehicles. For example, the maximum speed limit in the following areas is 55 miles per hour:

  1. Interstate highways
  2. Limited access highways with divided roadways
  3. Nonlinear access highways having four or more lane
  4. Other primary highways.

And 35 miles per hour in the following zones:

  1. Penalties for violating the absolute speed limit in Virginia

According to Virginia code 46.2 – 878 1, 46.2 – 878.3 and 46.2 – 873, the following penalties are applied if absolute speed limits are violated in Virginia:

  1. A fine of $6 per mile over the speed limit along with additional $55 as a processing fee.
  2. In residential area, the fine will exceed $200 along with an $8 per exceeded mile and $51 as a processing fee
  3. For areas close to schools the fine is $250 along with $8 per exceeded mile and a processing fee of $51
